EarthDoc – legal information

EarthDoc is a product of EAGE Publications BV (EAGE)

It is EAGE’s intention that users have access to the widest possible range of content and that this content can be used to enable the most effective research, study, teaching and practice of the Earth sciences. However, it is important that users recognise the substantial investment made by EAGE in protecting and enhancing the quality of the content it publishes. It is necessary, therefore, to impose conditions on the use of material available within EarthDoc.

In no event shall the EAGE, nor its host Ingenta, be liable for any direct, indirect, special, incidental, punitive or consequential damage (including, but not limited to, loss of data, business disruption or loss of profits) arising out of the use of, or the inability to use, EarthDoc content.

The content of EarthDoc is provided “as is”, and neither the EAGE, nor its host Ingenta, warrant or guarantee its accuracy, completeness, fitness for particular purpose or non-infringement.

Descriptions of, or references to, products, publications or services, or inclusion of any advertisement, neither constitutes nor implies guarantee, endorsement, support or approval of that product, publication or service.

There is no guarantee that the information contained online in EarthDoc is identical to that contained in any print version.

 

Terms of Use

Open Access content

Articles or Abstracts that have the ‘Open Access’ OA logo can be shared and posted to websites or servers without permission. However, if you reuse figures or other parts of the article you must acknowledge the author and the source of the material.

Articles with the ‘Free’ or ‘Free Trial’ FT logo are not the same as Open Access and are subject to the conditions below.


Other content

All articles, abstracts and other content published on EarthDoc that do not have the ‘Open Access’ OA logo, including ones that are subscribed to or free to access online, are subject to the conditions below.

  • Users are regarded as those who have access rights to some or all of EarthDoc content either because they are member of EAGE or are faculty members or students of, employees or contractors to institutions, universities or companies with subscription access to EarthDoc, or because they have been otherwise granted access by EAGE. 
  • Users shall not permit anyone to use or access EarthDoc.
  • Users may browse, search and access content and may download individual articles of interest to their hard drive for the legitimate pursuit of their personal research, study, teaching or practice. 
  • Users are not authorized to store the content in a digital or non-digital database such as intranet, digital document system or know-how system, especially if such database can be accessed by anyone else. Temporary storage of content is allowed in case of caching. Such a cache memory must be deleted regularly.
  • The use of, or reference to, any article or part of an article must include the customary full bibliographic citation to the work and its DOI (Digital Object Identifier number), where given. 
  • Users may not use the content for commercial purposes or personal gain, including but not limited to the sale of the content, bulk reproduction or distribution or publication of the content in any form, unless specifically permitted in these terms. Any individual or organisation wishing to reproduce or re-use EarthDoc content must make a formal permission request. 
  • Users may not systematically or automatically download multiple articles or abstracts. 
  • Users shall not provide (digital or non-digital) copies of any content from EarthDoc to any third parties.
  • Users may not remove, obscure or modify any copyright notifications or other notices regarding intellectual property rights included in the content.
  • Articles and abstracts are for the use of the individual and may not be posted on any internal or institutional website or intranet, nor may they be posted on any site where external access is possible. Specifically, articles and abstracts may not be posted on any institutional or subject-focused repository. 
  • Articles or abstracts may not be copied physically or electronically for any onward distribution and may not be provided to anyone who does not enjoy EarthDoc access in their own right. 
  • Access details, including usernames or passwords issued for the purpose of accessing EarthDoc or its content are strictly personal and must be treated as confidential and must not be shared with other Users, institutions or organisations. 
  • Any automated analytical technique aimed at analysing text and data in digital form in order to generate information including patterns, trends and correlations (so-called Text and Data Mining) may only be applied if it is done by a research organisation or cultural heritage institution solely for the purpose of (non-commercial) scientific research as mentioned in Clause 3 of Directive (EU) 2019/790 (the Digital Single Market Directive). Text and Data Mining for commercial purposes is not allowed; all rights in this respect are reserved pursuant to Clause 4 paragraph 3 of the Digital Single Market Directive.
  • In the event of any use that does not comply with these terms, EAGE Publications may bar such User's access to EarthDoc. 
  • In case of pay-per-view: Payment of the specified fee entitles the user to access to download their selected content in PDF format for the period indicated with the purchase. After the indicated period has expired no further access will be possible.
